In these Terms, “we”, “us”, “our” refer to the merchant above.

2) Using the Store

By using the Store or placing an order, you agree to these Terms and our policies referenced below:

You must be legally capable of entering into a contract where you live.

3) Products and fulfilment (CDs vs Printful)

We sell:

  • Self-fulfilled items (e.g., CDs) packed and shipped by us
  • Print-on-demand merchandise produced and shipped by Printful (a third-party fulfilment partner).
  • Digital products (e.g. digital downloads), made available by Digital Downloads.

If your order contains both types, you may receive separate shipments with separate delivery times/tracking.

Product photos are indicative; colors/appearance can differ due to screens and production methods.

4) Orders and contract formation

Placing an order is an offer to buy. A contract is formed when we accept your order and you receive an order confirmation. We may refuse or cancel an order (for example due to payment issues, suspected fraud, stock/production problems, or address problems). If we cancel after payment, we will refund you.

5) Prices, taxes, and payment

Prices shown at checkout apply at the time you place the order. Shipping costs are shown at checkout before you pay.

For international orders, your country may charge import duties/taxes/handling fees. Unless explicitly stated otherwise, these are your responsibility.

Payments are processed via Shopify-supported payment methods.

6) Shipping and delivery

Delivery estimates are shown at checkout and/or in the Shipping Policy. Delivery dates are estimates, not guarantees. Delays can occur due to carriers, customs, peak periods, or events outside our control.

For consumer orders, risk passes to you when you (or someone you nominate) receives the goods, unless you arranged your own carrier that we did not offer.

7) Returns, withdrawal, and refunds

Returns/refunds are handled under our Returns/Refund Policy: [LINK].

If you are an EU/EEA consumer, you generally have a 14-day right of withdrawal, with legal exceptions.

Sealed CDs: if a CD is supplied sealed and you unseal it after delivery, the right of withdrawal may no longer apply.

Digital products are made available immediately upon purchase.

By completing the purchase, the customer expressly consents to immediate performance and acknowledges that they lose their right of withdrawal once access to the digital content has been granted.

Therefore, all sales of digital products are final and non-refundable after delivery.

Nothing in these Terms limits mandatory consumer rights.

8) Defects, damage, wrong items

If your order arrives defective, damaged, or incorrect, contact store@newmarshallplan.com with your order number and clear photos. For Printful-fulfilled products we may need to file a partner claim within a limited timeframe, so contact us promptly.

9) Intellectual property

All Store content (text, images, branding, artwork) is owned by us or our licensors and may not be used commercially without written permission.

10) Liability (minimal)

To the extent permitted by law, we are not liable for indirect or consequential loss (e.g., lost profits). Our total liability for any claim is limited to the amount you paid for the relevant order, except where mandatory law requires otherwise.

11) Changes

We may update these Terms by posting a new version on the Store. The “Last updated” date indicates when changes apply.

12) Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Utrecht, unless mandatory consumer law provides otherwise.
